Terms of Service, All Well Daily

These terms are the agreement between you and Sadie Innovations LLC (based in North Carolina, USA) for using All Well Daily, our app and website. By using All Well Daily, you agree to these terms. We have written them in plain language on purpose; if anything is unclear, email support@allwelldaily.com and ask.

All Well Daily is launching soon; these terms apply from launch.

What All Well Daily is

All Well Daily is a daily check-in aid. You choose a deadline time each day, and you tap "I'm OK" before it. The app reminds you as your deadline approaches. If you miss your deadline and a 15-minute grace period after it, All Well Daily sends a text message, in the words you set, to the contacts you chose, suggesting they check on you. If you press the SOS button, the alert is sent straight away.

The most important thing first

All Well Daily is not an emergency service. It is a reminder and notification aid, nothing more.

  • It is not a substitute for calling 911 or your local emergency number. If you or anyone else is in danger, call the emergency services.
  • It does not contact the police, an ambulance, or any emergency service. It only texts the contacts you chose.
  • It does not monitor your health, your location, or your home.
  • It cannot guarantee that anyone will see your alert, respond to it, or be able to help.

Please set it up as one extra safety net among others, not as your only one. Tell your contacts what the alert means and what you would like them to do if they receive one.

Alerts cannot be guaranteed

We work hard to make alerts reliable, including watching your deadline on our server so an alert can still be sent if your phone is off or out of signal. Even so, alerts depend on things outside our control: phones, mobile networks, the internet, and our texting provider.

That means:

  • An alert might be delayed, or might not arrive at all.
  • A reminder might not reach you.
  • The service might be unavailable for a time, for example during maintenance or a provider outage.

You accept that All Well Daily cannot promise that every alert will be delivered, or delivered on time. Do not rely on it as the only way someone would know you need help.

Your responsibilities

So the service can work as intended, you agree to:

  • Tell your contacts they are listed. Only add people who know they are your contacts and have agreed to it. If someone asks to be removed, remove them.
  • Keep information current. Your contacts' numbers, your deadline, and your settings must stay up to date. An alert sent to an old number helps no one.
  • Check in honestly. The service believes your "I'm OK" tap. It cannot tell whether you are actually well.
  • Look after your phone and account. Keep your device secure, and let us know at support@allwelldaily.com if you think someone else has access to your account.
  • Be an adult user. All Well Daily is intended for adults.

Acceptable use

You agree not to:

  • Use All Well Daily to harass, alarm, or mislead anyone, including by listing contacts who have not agreed, or sending false alerts on purpose.
  • Use it for anyone else's account or contacts without their clear agreement (for example, setting up check-ins for a parent is fine with their knowledge and agreement).
  • Try to break, overload, reverse-engineer, or get around the security of the service.
  • Use it for anything unlawful.

If someone uses All Well Daily in these ways, we may suspend or close their account.

Paid plans

All Well Daily may offer paid plans as well as a free service.

If you choose a paid plan:

  • It is billed through the Apple App Store or Google Play, under their payment terms, we do not take your card details ourselves.
  • Subscriptions renew automatically unless you cancel.
  • You can cancel at any time in your App Store or Google Play subscription settings; cancellation takes effect at the end of the period you have paid for.
  • Refunds are handled by Apple or Google under their own policies.

Pausing and ending the service

  • You can pause your daily check-ins at any time (for a holiday, for example), resume them when you wish, or delete your account and information, see our Privacy Policy and the Delete Account/Data page.
  • We may change, pause, or end All Well Daily. If we ever end the service for good, we will give you reasonable notice where we can, and you will be able to delete your information.
  • We may suspend an account that breaks these terms.

Our responsibility, in plain words

We will run All Well Daily with reasonable care and skill, and we will fix problems we find as quickly as we sensibly can.

To the fullest extent the law allows:

  • We are not responsible for losses caused by things outside our reasonable control, including network or provider failures, alerts that are delayed or not delivered, or a contact not seeing or acting on an alert.
  • We are not responsible for indirect losses, things like lost income or missed opportunities, that result from the service not working as hoped.
  • Our total responsibility to you for any claim connected with All Well Daily is limited to the amount you paid us for the service in the 12 months before the claim. If you use only the free service, that amount is zero, which is a further reason not to rely on All Well Daily as your only safety net.
  • Nothing in these terms limits responsibility that the law does not allow us to limit, for example, responsibility for death or personal injury caused by our negligence, or for fraud.

Privacy

How we handle your information is described in our Privacy Policy, which forms part of your agreement with us.

Changes to these terms

If we change these terms in a way that matters, we will update this page and, where we can, let you know by email or in the app before the change takes effect. Continuing to use All Well Daily after a change takes effect means you accept the updated terms.

The law that applies

These terms are governed by the laws of the State of North Carolina, USA, and any dispute about them or about All Well Daily will be handled in the courts of North Carolina, unless the law gives you the right to bring a claim elsewhere.

If any part of these terms is found to be unenforceable, the rest still stands.
